The product is to be used only on safe, dry, smoothly paved or hard packed surfaces, in accordance with local regulations, during daylight hours. Purchaser obtains her/his own insurance. Seller assumes no suitability of any of these products as to size, age and other factors largely depend on personal discretion. Release

The User releases MyEBike.biz, it's officers, agents, sponsors and employees from claims, demands and damages (both actual and consequential), of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with items purchased, or purchases made on or through this website.

Limitation of Liability

In no event shall MyEBike.biz its suppliers be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site or items purchased on or through our site or this agreement (however arising, including negligence). Purchaser Responsibility

You must inspect all equipment before using it and to take full responsibility for assuring that the equipment is in good working order and safe to use. This includes, but is not limited to, ensuring that all bolts are tight prior to riding (bolts sometimes loosen during shipment or while riding), tires are properly inflated (if applicable), and brakes are in working order and properly adjusted. You further understand that you are responsible for damage to equipment. Purchaser understands the nature of motor scooter riding and motorcycle related activities and acknowledges that Purchaser is qualified to operate said motor scooter, and is in proper physical condition to participate in such activity. Purchaser agrees to assume all risks when allowing others to operate Purchaser's scooter. If Purchaser is not familiar with the nature of motor scooter riding, Purchaser should seek professional training before operating a scooter. Purchaser understands that motorized scooters require basic mechanical knowledge to properly assemble and maintain. In the event Purchaser receives item with damaged part(s), and MyEBike.biz agrees to replace said part(s), it is the Purchaser's responsibility to properly identify the part(s) needed to repair the item.

Inherent Risks

Warning! Scooter riding activities involve the risk and danger of serious bodily injury including, but not limited to, disability, paralysis, dismemberment and death. These inherent risks and dangers may be caused by Purchaser's own actions or inactions, the actions or inactions of others, participating or not participating in the activity, the condition in which the activity takes place, or the negligence of others. There may be additional risks, including social and economic loss, either known or unknown to Purchaser, not readily foreseeable, and Purchaser fully accepts and assumes responsibility for all such risks, losses, costs, and damages incurred as a result of Purchaser s participation in scooter riding activity.

Operation, Registration, and License

Purchaser is responsible for registering and operating the motor scooter in accordance with local and state laws and ordinances. Seller makes no representations that the motor scooter is legal for operation in your city and state. It is the purchaser's responsibility to check all local laws and ordinances prior to purchasing a scooter.

Notice

Any notice required under the agreement shall be given as follows: notice from User to MyEBike.biz shall be in writing and shall be made either via email or certified mail; notice from MyEBike.biz to User shall be in writing and shall be made either via email, certified mail or may be posted as part of the MyEBike.biz website.

Pricing, Typographical, and Photographic Errors

The law regards the 'electric-assisted' (Washington) or 'motorized bicycle' (California) as a non-motorized vehicle and as a bicycle. Laws in other states and local ordinances are similar. Federal law PL107-319 in the U.S. defines the electric-assisted bicycle as a non-motorized vehicle (i.e. bicycle) and places it under the jurisdiction of the Consumer Protection Commission (rather than DOT).
